John Fifield represented Osborne House at the Manchester LVT and has got the Assessment reduced from RV £82,500 to £1 whilst their office building on Gadbrook Park was undergoing a major refurbishment. The VO argued that they could assume that the building was in repair but LVT rejected this argument and accepted John Fifield’s submission that the Assessment should be reduced to “building undergoing reconstruction” with effect from the commencement of the stripping out works. This followed the recent Supreme Court ruling in Newbigin -v- Monk. John Fifield commented “this is a victory for common sense”.
